Annual Registration and Fees

All pesticide products sold, repackaged, or manufactured in Utah must be registered annually. The registration fee is $195 per product, payable to the Utah Department of Agriculture and Food. Registrations expire on June 30 each year, and renewals not received by this date incur a $25 late fee per product. Products not registered by August 31 will face additional penalties, including citations and escalating fines (Utah Department of Agriculture) (Utah Department of Agriculture).

Submission Requirements

For initial registration, applicants must submit a current label for each new product along with the application form. If the product label has not changed from the previous year, this should be indicated on the renewal application. Any changes in labeling must be reported. Additionally, if a product is to be discontinued, a letter must be submitted, or the product must be paid for the next two years to confirm it is no longer in the channels of trade (Utah Department of Agriculture).

Compliance and Enforcement

Failure to register by the deadlines results in citations and fines. Initially, a $100 citation is issued, which doubles every 15 days if not paid, up to a maximum of $400. If the citation remains unpaid after 30 days, the UDAF may request a hearing with the company (Utah Department of Agriculture) (Utah Department of Agriculture).

Exemptions and Special Cases

Certain products, like those classified under the EPA's 25(b) exemption, are considered minimal risk pesticides and may have different registration requirements. However, these products still need to be registered and pay the annual fee (Utah Department of Agriculture).
