EPA Compliance Prior to State Registration
Most pesticides must first be registered with the Environmental Protection Agency (EPA) under Section 3 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This ensures the product has been reviewed for safety and efficacy. Once a pesticide is federally registered, it can then be registered in North Carolina.

Submission of Application and Fees
Registrants must complete a New Pesticide Product Registration Form and submit it alongside the end-use labeling for the product.
The registration fee for a new or renewed product is $150. Additionally, the Pesticide Environmental Trust Fund (PETF) assessment applies ($25) if the previous fiscal year’s sales in the state were $5,000 or less, or $50 if sales exceeded $5,000.
Label Review
Although products registered federally have their labeling reviewed by the EPA, North Carolina conducts its own review to ensure compliance with state-specific requirements. This is especially important for minimum risk pesticides, whose labels are scrutinized to ensure they meet EPA standards.
Stop Sale Orders
If an unregistered pesticide is found being sold or offered for sale in the state, a Stop Sale, Stop Use, or Removal Order is issued. Registrants can resolve these orders by completing the registration process, although a $200 delinquency penalty will apply.
Annual Renewal
Pesticide registrations must be renewed annually, with fees and assessments adjusted based on the product’s sales in the previous fiscal year.
