EPA Compliance Prior to State Registration

Before a pesticide can be registered in Arkansas, it must first be registered with the Environmental Protection Agency (EPA) under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Once a product has received EPA approval, it can then be registered with the Arkansas State Plant Board.

Arkansas Pesticide Regulatory Compliance

All pesticides—including substances intended to prevent, destroy, repel, or mitigate pests, as well as plant regulators, defoliants, desiccants, and spray adjuvants—must be registered in Arkansas before they are distributed, sold, or offered for sale. This registration ensures that the product complies with the Arkansas Pesticide Control Act, which governs pesticide use in the state.

Required Documentation for Arkansas Registration

Application Form (DP-21)

The DP-21 Application for Registration of Pesticides must be completed and submitted. The form is available on the Arkansas Department of Agriculture website and can be submitted either by mail or online.

Product Label

A PDF of the product label must be provided. The file should include the complete product name and EPA Registration Number. Labels are required for both new products and any products with revised labels.

Registration Fees

The registration fee is $250 per product. If the product is not exempt from the Abandoned Pesticide Disposal (APD) Fee, the total fee is $320 per product.

Registration Timeline and Fees

Pesticide registrations in Arkansas must be renewed annually, with the registration year ending on December 31. Late renewals may be subject to additional fees. A two-year discontinuance period is allowed for products being phased out, ensuring they are removed from the channels of trade.

Exemptions

Certain products, such as those exempt under FIFRA Section 25(b) (which includes some natural or minimum-risk pesticides), still require state registration in Arkansas. However, they are registered in the same manner as other products.

Compliance and Enforcement

The Arkansas State Plant Board actively monitors compliance with pesticide regulations. This includes licensing dealers and applicators and enforcing regulations to ensure public and environmental safety. Non-compliance can result in penalties, including fines and revocation of registration or licenses.
