EPA Compliance Prior to Missouri State Registration
Before registering a pesticide in Missouri, the product must first be registered with the Environmental Protection Agency (EPA) under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This step ensures that the pesticide has been evaluated for safety and efficacy at the federal level. Once federally registered, the pesticide can then be registered with the Missouri Department of Agriculture.
Missouri Pesticide Regulatory Compliance
All pesticide products intended for sale in Missouri, including general-use and restricted-use pesticides, must be registered with the MDA. The state also requires registration for adjuvants—substances added to pesticides to enhance their effectiveness.
Requirements for Missouri Registration
To register a pesticide product in Missouri, the following must be submitted:
Product Label
A copy of the pesticide label must be submitted during the registration process. The label should be emailed in PDF format to the MDA. Missouri does not require Material Safety Data Sheets (MSDS) for registration.
Application Form
The application for pesticide registration can be completed online through Missouri’s MOPlants portal or by mail. The portal also allows for the renewal of existing product registrations.
Registration Fees
The registration fee for each pesticide product is $200, which must be paid annually. Products must be registered each year, with the registration period running from January 1 to December 31.
Label Revisions
Any significant changes to the pesticide label require a new registration. The new and old labels must be registered if both are still in trade within the state.
Exemptions and Special Cases
FIFRA 25(b) Products
Products that are exempt from federal registration under FIFRA 25(b) are also exempt from registration in Missouri.
Special Local Need (SLN) Registrations
Section 24(c) registrations allow Missouri to register additional uses for a federally registered pesticide to meet special local needs.
Experimental-Use Permits
These are granted for experimental use of pesticides and may also be exempt from state registration under specific conditions.
Compliance and Enforcement
The MDA’s Bureau of Pesticide Control is responsible for ensuring that all pesticide products comply with Missouri’s regulations. The Bureau also oversees licensing of pesticide applicators and dealers, conducts inspections, and enforces the Missouri Pesticide Use Act.
